In Florida, a drunk driving accident means that the driver who is operating the car who runs the red light or runs a stop sign is operating the car with a blood alcohol level of over .08. Basically if you get a blood alcohol level of over .08, then you’re presumed to be operating the vehicle while intoxicated. That can give a lot of problems to the driver, not only in the criminal aspect but also in the civil arena because now the driver can be exposed to punitive damages, or damages to punish that driver for driving under the influence that would not be covered by insurance.
