What is comparative fault?

by James Holliday, posted in Personal Injury

In Florida, we have something known as comparative fault. And what that really means is that when a jury is listening to all the evidence at a trial, they can divide the fault up in a pie chart. And so they could actually say, the plaintiff who’s injured is 50% at fault and the other driver is 50% at fault and that means that you will only get 50% of the harm caused. So if the verdict is $100,000 you’ll only get $50,000. So it’s very important to call an experienced trial lawyer. Here at Holliday Karatinos, we wanna make sure that you get your full measure of justice. If you’ve been hurt in an accident, please give me a call I’d like to sit down with you and your family and see how we can best help.
